THE HUB “CREATE A STORY” CONTEST OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN.

A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

OFFERED ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (“U.S.”) WHO ARE 18 YEARS OF AGE AND OLDER AND WHO ARE EMPLOYED, DURING THE TERM OF THE CONTEST AND WHEN PRIZE IS AWARDED, AS TEACHERS AT AN ACCREDITED PUBLIC, PRIVATE OR PAROCHIAL ELEMENTARY SCHOOL IN THE UNITED STATES CONTAINING ANY CLASS WITH STUDENTS FROM KINDERGARTEN THROUGH GRADE 5, THAT HAS A 501(C)(3) OR 509(A)(1) TAX-EXEMPT DESIGNATION.

  1. ELIGIBILITY: The Hub “Create a Story” Contest (“Contest”) is open only to legal U.S. residents who are 18 years of age and older and who are employed, during the Term of the Contest and when prize is awarded, as teachers at an accredited public, private or parochial elementary school in the United States containing any class with students from Kindergarten through Grade 5, that has a 501(c)(3) or 509(a)(1) tax-exempt designation (“Teacher”). Employees, officers and directors of Discovery Communications, LLC ("Sponsor"), Hub Television Networks, LLC (“Hub”), their respective parent companies, subsidiaries, affiliates, TV production partners, advertising agencies, promotional suppliers (collectively, "Contest Entities") and the immediate family members (spouses and parents, children and siblings and their spouses, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible. All applicable federal, state, and local rules apply. Void where prohibited or restricted by law.

  2. TO ENTER: The Contest begins at 5:00 PM Eastern Time (“ET”) on October 8, 2010 and ends at 5:00 PM ET on December 17, 2010. The objective of the Contest is for Teachers to work with and supervise a group of students (“Groups”) within a classroom setting in the creation of a story based on one of four Hub programs (“Strawberry Shortcake”, ”Transformers”, “Twisted Whiskers” or “Fraggle Rock”). Groups will craft a story based on either a set of images and/or a short video clip provided by Sponsor. Group members must work together to write (a maximum of two pages double spaced, 12 point font), review, edit and finalize the story.

  3. Groups must be comprised of students in either: [a] Kindergarten through Grade 2; or [b] Grade 3 through Grade 5. Grade K-2 entries will be judged separately from Grade 3-5 entries. If a class includes two grade levels, Teacher should group students in the same grade together. If a Group includes two grade levels then the higher grade level will be used to determine which grade band the Group will be judged in.

    To enter, go to www.hubforteachers.com and click on the section titled “Contest.” There is a “Submit” area that should be used to enter the Contest. All entries and associated entry information must be submitted by a Teacher on behalf of a Group. Each entry must be the Group’s own work, without assistance from anyone else.

    Entry must be entirely original to the Group and must NOT include mention or performance of any copyrighted material (except for the material provided by Sponsor for this Contest) including but not limited to music, films, books, television programming, etc., or identifying descriptions of any media property without permission. The entry must not include any use of a trademark or logo owned by another party. All entries become the property of Sponsor and will not be returned to the entrant. Students may only participate in one Group but Teachers may submit entries on the behalf of multiple Groups.

    From December 20, 2010 to January 24, 2011, a panel of judges selected by Sponsor ("Judging Panel") will review each entry and select two (2) Grand Prize winners (a Grade K-2 winner, and a Grade 3-5 winner) from the total number of entries. The entry will be scored based on the following criteria:

    • Creative Storyline/Content – 50%
    • Flow & Structure – 25%
    • Originality of incorporating material provided by Sponsor – 25%

    In the event of a tie, the winning entry will be determined by the highest score from amongst the tied entries in "Creative Storyline/Content.” By entering, Teacher warrants and represents that they agree to be bound by these Official Rules and the final decision of the Sponsor.

  4. PRIZES: On or about January 30, 2011, Sponsor will award one (1) Grand Prize each to one (1) Grade K-2 entry and one (1) Grade 3-5 entry consisting of a Hub prize pack for all students in the winning groups and one (1) classroom digital prize pack that includes a green screen, FLIP video camera and digital storytelling software. The approximate value of the Grand Prize is $1050 USD. The Hub prize pack will be awarded to each member of the winning Group while the digital prize pack will be awarded to the Teacher on their school’s behalf. In addition, the winning Groups and Teachers will be showcased on www.hubforteachers.com.

    Restrictions, conditions, and limitations apply. Prizes cannot be transferred, substituted or redeemed for cash (in whole or in part) except at the sole discretion of Sponsor. Sponsor makes no warranties, representations or guarantees, expressed or implied, respecting the performance or use of the prize, and expressly disclaims the warranties of quality, merchantability and fitness for a particular purpose.

    Odds of winning will be determined by skill of the entrants and the quality of eligible entries received. Potential winners will be notified by phone, email, postal mail and/or express mail at Sponsor’s sole discretion. Inability to contact a potential winner or the return of any prize notification as undeliverable will result in the prize being forfeited and awarded to the next highest scoring alternate potential winner. The potential winners will be required to complete an affidavit of eligibility, a liability release and (where legal) a publicity release, which must be returned within the time period specified in the notification letter or Sponsor, in its sole discretion, may select an alternate potential winner. Each winning student’s parent must ratify and sign any and all documents required of the student.

  5. GENERAL: Taxes on prize and all expenses related to acceptance and use of prize are the sole responsibility of the winners. Parent/legal guardian of each member of a winning Group will be required to complete and return a Parental Release Form prior to prizes being awarded. By participating, entrants and their parents agree [a] to these rules and decisions of Sponsor, which shall be final in all respects relating to this Contest; [b] to release, discharge and hold harmless Contest Entities from any and all injuries, liability, losses and damages of any kind resulting from their participation in the Contest or their acceptance, use or misuse of prize including, without limitation, personal injury, death and property damage; and if a winner, [c] to permit Contest Entities to use his or her name, photograph, likeness, statements, biographical information, voice, voice likeness and city and state address for advertising, publicity and promotional purposes in all media, including but not limited to on air and within www.discovery.com, www.hubworld.com and www.hubforteachers.com, in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Sponsor, its respective affiliates, subsidiaries, advertising and promotion agencies, agents and representatives, and the officers, directors and employees of each are not responsible for and shall not be liable for [a] any telecast, cable or telephone malfunctions, human error, satellite transmission failures, or delayed telecasts or preemption of or the failure of a cable affiliate to televise Discovery Channel® or any affiliated Sponsor network throughout the world; [b] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [c] failed, incomplete, garbled or delayed computer transmissions; [d] late, lost, misdirected or incomplete entries or postage-due mail; or [e] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Contest if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest (or portion thereof), as determined by Sponsor in its sole discretion, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. Entry information becomes property of Sponsor. Internet entry must be made by the Group’s Teacher only at the authorized web site address of www.hubforteachers.com. Entries may not be made by any other individual or any entity, and/or originate at any other Internet website or e-mail address, including but not limited to commercial contest subscription notification and/or entering service sites. Any winner who enters by any of the methods described above will be disqualified and an alternate winner selected. Use of any device to automate entry is prohibited. Sponsor reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules. This Contest is governed by the laws of the State of Maryland, with jurisdiction and venue in Montgomery County, Maryland, and all claims must be resolved in the courts of Montgomery County, Maryland.

  6. ENTRY INFORMATION: Please note that by entering this Contest and by checking any “opt-in” boxes on the entry form for this promotion, you (Teacher) are [a] agreeing that the Sponsor may share your entry information (including your name, address, email address, etc.) with our promotional partners and other parties; and [b] granting us, our promotional partners and other third parties with which we choose to share your information, permission to contact you about our upcoming shows, promotions or for other reasons. You may enter this Contest but keep your entry information private by not checking the “opt-in” boxes on the entry form. The collection and use of entrant information will be governed by Sponsor’s on-line privacy policy, available for viewing at http://www.discovery.com/utilities/about/privacypolicy.html.

  7. INDEMNITY: By participating, Teacher agrees to indemnify and hold the Contest Entities harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Entities due to or arising out of such entrant’s entry, such entrant’s conduct in creating an entry or otherwise in connection with this Contest, including but not limited to: claims for trademark infringement; copyright infringement; violation of an individual’s right of publicity or right of privacy; or defamation.

  8. RIGHTS IN ENTRY MATERIALS: By participating, Teacher hereby assigns to The Hub: [a] all rights of ownership, reproduction and use of story and entry materials for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-fee, worldwide right, in all media (now known or later developed) to use, publish, alter or otherwise exploit entries; and [b] use of Teacher’s name, school, city and state and/or photograph and any video footage of winners recorded for programming, advertising, publicity and promotional purposes without compensation (unless prohibited by law) and without prior approval or inspection, and agree to execute specific consent to such use if asked to do so.

  9. WINNER LIST: To receive a list of winners, mail a self-addressed, stamped envelope to be received by March 31, 2011, to: The Hub “Create a Story” Contest Winners List, PMI Station, PO Box 750, Southbury, CT 06488-0750.
